Ліцензійна угода кінцевого користувача Veylo (EULA)

1. Сторони
Ця угода укладена між вами (користувачем) і розробником застосунку Veylo — Денисом Ординським, вул. Івана Пулюя, 1а, Київ, 03048, Україна, gehucka@gmail.com («Розробник»). Угода укладена лише між вами й Розробником, а не з Apple Inc. («Apple»). За застосунок і його вміст відповідає Розробник, а не Apple. Ця угода не може містити правил використання, що суперечать Умовам використання App Store (Usage Rules).
2. Ліцензія
На час дії вашої підписки (п. 4) Розробник надає вам невиключну ліцензію без права передачі на використання Veylo на пристроях Apple, якими ви володієте або які контролюєте, згідно з Правилами використання App Store. Застосунок також можуть використовувати інші облікові записи, пов'язані з покупцем через «Сімейний доступ», якщо його увімкнено. Ви не можете продавати, здавати в оренду, декомпілювати чи модифікувати застосунок, крім випадків, дозволених законом, і крім даних, описаних у п. 3.
3. Дані OpenStreetMap
Карта, дороги й інші географічні дані у Veylo походять з OpenStreetMap і поширюються за ліцензією Open Database License (ODbL) 1.0: © OpenStreetMap contributors. Обмеження цієї угоди не поширюються на ці дані: ви можете використовувати їх згідно з ODbL. Копію даних, вбудованих у застосунок, надішлемо безкоштовно на запит: gehucka@gmail.com. 4. Підписка
Veylo працює лише з активною підпискою «Veylo Київ» (на місяць, на 3 місяці або на рік). Нові підписники отримують 3 дні безкоштовно — один раз на Apple ID. Підписка продовжується автоматично на той самий строк за чинною ціною, якщо її не скасувати щонайменше за 24 години до кінця поточного періоду; оплата списується з вашого облікового запису Apple. Керувати підпискою й скасувати її можна в налаштуваннях Apple ID. Після закінчення підписки застосунок показує екран підписки, але поїздка, яка вже триває, не переривається. Ціни, платежі, повернення коштів і податки обробляє Apple за своїми умовами; про зміну ціни Apple повідомляє заздалегідь. У підписку входять оновлення застосунку, карти й доріг та онлайн-пошук адрес; дані OpenStreetMap лишаються вільними згідно з п. 3.
5. Ведення маршрутом і безпека
YOUR USE OF THIS REAL TIME ROUTE GUIDANCE APPLICATION IS AT YOUR SOLE RISK. LOCATION DATA MAY NOT BE ACCURATE.
Ви користуєтеся підказками маршруту в реальному часі на власний ризик. Дані про місцезнаходження можуть бути неточними, зокрема коли сигнал GPS глушать або підмінюють. Час у дорозі — оцінка без урахування заторів. Покриття — лише Київ і Київська область. Завжди дотримуйтеся Правил дорожнього руху, дорожніх знаків і вказівок уповноважених осіб — вони мають перевагу над підказками застосунку. Не керуйте телефоном під час руху: закріпіть його в тримачі, а кроки вручну доручіть пасажирові. Veylo не призначений для екстрених ситуацій, порятунку життя чи керування транспортним засобом.
6. Підтримка
Підтримку надає Розробник: https://imdennie.com/veylo/support/ , gehucka@gmail.com. Apple не має жодних зобов'язань щодо технічного обслуговування чи підтримки застосунку.
7. Гарантії
Застосунок надається «як є» в межах, дозволених законом. Розробник відповідає за гарантії, передбачені законом, якщо від них неможливо дійсно відмовитися. Якщо застосунок не відповідає застосовній гарантії, ви можете повідомити Apple, і Apple поверне вам ціну покупки застосунку (якщо вона була). У максимальних межах, дозволених законом, Apple не має інших гарантійних зобов'язань щодо застосунку; будь-які інші претензії, збитки чи витрати через невідповідність гарантії — відповідальність Розробника.
8. Претензії щодо застосунку
Розглядати претензії — ваші чи третіх осіб — щодо застосунку або його використання відповідає Розробник, а не Apple, зокрема: (і) претензії щодо відповідальності за продукт; (іі) претензії, що застосунок не відповідає вимогам законодавства чи регулювання; (ііі) претензії за законодавством про захист прав споживачів, приватність чи подібним законодавством.
9. Інтелектуальна власність
Якщо третя особа заявить, що застосунок або володіння й користування ним порушує її права інтелектуальної власності, розслідувати, захищатися, врегульовувати й задовольняти таку претензію відповідає Розробник, а не Apple.
10. Відповідність законодавству
Ви підтверджуєте, що (і) не перебуваєте в країні, щодо якої діє ембарго уряду США або яку уряд США визначив як таку, що підтримує тероризм, і (іі) не внесені до жодного списку заборонених чи обмежених осіб уряду США.
11. Умови третіх осіб
Користуючись застосунком, дотримуйтеся умов договорів із третіми особами, наприклад вашого мобільного оператора.
12. Apple як третя особа-вигодонабувач
Apple і дочірні компанії Apple є третіми особами-вигодонабувачами цієї угоди. Прийнявши її умови, ви погоджуєтеся, що Apple має право (і вважається такою, що прийняла право) вимагати виконання цієї угоди від вас як третя особа-вигодонабувач.
13. Обмеження відповідальності
У максимальних межах, дозволених законом, Розробник не відповідає за непрямі збитки, втрачену вигоду чи наслідки рішень, ухвалених на підставі підказок застосунку. Ніщо в цій угоді не обмежує ваших прав споживача, від яких неможливо відмовитися за законом.

15. Застосовне право та зміни
До цієї угоди застосовується право України, якщо імперативні норми не встановлюють іншого. Розробник може змінювати угоду; нова редакція публікується за адресою https://imdennie.com/veylo/terms/ і застосовується до наступних версій застосунку.

Veylo End User License Agreement (EULA)
Effective 12 October 2026. Version 1. This is a translation; if the versions differ, the Ukrainian version prevails.
1. Parties
This agreement is concluded between you (the user) and the developer of Veylo, Denys Ordynskyi, 1a Ivana Puluya St, Kyiv 03048, Ukraine, gehucka@gmail.com (the "Developer"). It is concluded between you and the Developer only, and not with Apple Inc. ("Apple"). The Developer, not Apple, is solely responsible for the app and its content. This agreement may not provide for usage rules that conflict with the App Store Terms of Service (Usage Rules).
2. Licence
For as long as your subscription (section 4) is active, the Developer grants you a non-exclusive, non-transferable licence to use Veylo on Apple-branded products that you own or control, as permitted by the App Store Usage Rules. The app may also be accessed and used by other accounts associated with the purchaser via Family Sharing, where enabled. You may not sell, rent, decompile or modify the app except as permitted by law and except for the data described in section 3.
3. OpenStreetMap data
The map, roads and other geographic data in Veylo come from OpenStreetMap and are licensed under the Open Database License (ODbL) 1.0: © OpenStreetMap contributors. The restrictions of this agreement do not apply to this data; you may use it under the ODbL. A copy of the data built into the app is available free of charge on request: gehucka@gmail.com. 4. Subscription
Veylo works only with an active "Veylo Київ" subscription (for a month, 3 months or a year). New subscribers get 3 days free, once per Apple ID. The subscription renews automatically for the same period at the current price unless cancelled at least 24 hours before the end of the current period; payment is charged to your Apple account. You can manage and cancel the subscription in your Apple ID settings. When the subscription ends, the app shows the subscription screen, but a drive in progress is not interrupted. Prices, payments, refunds and taxes are handled by Apple under its terms; Apple announces price changes in advance. The subscription includes updates of the app, the map and roads, and the online address search; OpenStreetMap data stays free under section 3.
5. Route guidance and safety
YOUR USE OF THIS REAL TIME ROUTE GUIDANCE APPLICATION IS AT YOUR SOLE RISK. LOCATION DATA MAY NOT BE ACCURATE.
Location data may be inaccurate, in particular when the GPS signal is jammed or spoofed. Travel times are estimates without traffic. Coverage is Kyiv and Kyiv oblast only. Always follow the traffic rules, road signs and instructions of authorised persons; they take priority over the app's directions. Do not operate the phone while driving: mount it in a holder and leave manual steps to a passenger. Veylo is not intended for emergencies, life-saving purposes or vehicle control.
6. Support
Support is provided by the Developer: https://imdennie.com/veylo/support/ , gehucka@gmail.com. Apple has no obligation whatsoever to furnish any maintenance or support services for the app.
7. Warranty
The app is provided "as is" to the extent permitted by law. The Developer is responsible for any warranties provided by law, to the extent not effectively disclaimed. If the app fails to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price of the app (if any) to you. To the maximum extent permitted by law, Apple has no other warranty obligation with respect to the app, and any other claims, losses, liabilities, damages, costs or expenses attributable to any failure to conform to any warranty are the Developer's responsibility.
8. Product claims
The Developer, not Apple, is responsible for addressing any claims by you or any third party relating to the app or your possession and use of it, including: (i) product liability claims; (ii) any claim that the app fails to conform to any applicable legal or regulatory requirement; and (iii) claims arising under consumer protection, privacy or similar legislation.
9. Intellectual property
In the event of any third-party claim that the app or your possession and use of it infringes that third party's intellectual property rights, the Developer, not Apple, is solely responsible for the investigation, defence, settlement and discharge of any such claim.
10. Legal compliance
You represent and warrant that (i) you are not located in a country that is subject to a U.S. Government embargo, or that has been designated by the U.S. Government as a "terrorist supporting" country; and (ii) you are not listed on any U.S. Government list of prohibited or restricted parties.
11. Third-party terms
You must comply with applicable third-party terms of agreement when using the app, for example your mobile carrier's terms.
12. Apple as third-party beneficiary
Apple and Apple's subsidiaries are third-party beneficiaries of this agreement, and upon your acceptance of its terms, Apple will have the right (and will be deemed to have accepted the right) to enforce this agreement against you as a third-party beneficiary.
13. Limitation of liability
To the maximum extent permitted by law, the Developer is not liable for indirect damages, lost profits or the consequences of decisions made on the basis of the app's directions. Nothing in this agreement limits consumer rights that cannot be waived by law.

15. Governing law and changes
This agreement is governed by the law of Ukraine unless mandatory rules provide otherwise. The Developer may change this agreement; a new version is published at https://imdennie.com/veylo/terms/ and applies to later versions of the app.
